In December 2000, temporary social housing residents fly tipped on the triangle of flood plain land adjacent to the rear of 15 Wentworth Street properties. This rubbish contained soiled nappies, hypodermic needles, soiled mattresses, rotting household waste and piled up dustbin liners overflowing with evil smelling waste. Erewash Borough Council publicly REFUSED to take any action as in their view it did not constitute a health hazard and was not classed as litter.

THIS FLY TIPPING WAS LEFT TO COLONISE FOR ALMOST 6 YEARS. ON THE 4th OF SEPTEMBER 2006 EREWASH BOROUGH COUNCIL SUDDENLY STARTED TO PILE THE DEBRIS INTO A HEAP READY FOR REMOVAL. AFTER SIX YEARS EREWASH BOROUGH COUNCIL HAD FINALLY DECIDED IT WAS A HEALTH HAZARD AFTER ALL.
The triangle of flood plain land the fly tipping had colonised contained a mature, well established copse of trees. These trees created a valuable wildlife barrier on land which served as a buffer between residential and complete heavy industrial encroachment. As the fly tipping was finally going to be removed, the residents saw an opportunity to also improve the area their gardens backed on to by clearing the remaining accumulation of debris away and planting additional trees to add to the existing vegetation. On Sunday the 10th of September 2006 the residents worked on a voluntary basis, and at their own cost hired a mechanical digger to clear the remainder of almost six years of neglect away.

Not only did Rayden Engineering ignore the residents obviously staked out intention to occupy and improve the land, but also trespassed onto the 1937 established easement boundary attached to the entire row of 15 properties, thus acquiring an additional strip of land. This 69 year old established easement was clearly staked out with bunting from the previous day and Rayden Engineering's own Title Deeds also show the exact width of the easement which had just been taken from the residents.

Then instead of taking Enforcement Action to remove a 2.4m palisade fence erected without planning permission, EBC made Rayden Engineering paint it an "invisible" green so we would not notice it!
